Terms of Service

These terms govern use of Victorium Systems by a business. If you book an appointment with a business that uses Victorium Systems, you are that business’s client — your agreement is with them, and only the messaging section below applies to you directly.
What we provide
Booking software, a public booking page, an AI assistant that answers messages and books appointments, automated reminders, and reporting. Card payments are processed by Stripe and paid into your own account — we never hold your money. Stripe charges you its own standard processing rate on those payments, set and published by Stripe. We take no percentage, no application fee, and no share of what your clients pay you; our only charge to you is the subscription described below.
The AI assistant, and what it may promise
The assistant acts on your behalf when it answers your clients. Its authority is deliberately limited, and those limits are enforced by the software rather than left to the model’s judgement.
It may
- Quote prices, durations and availability exactly as you have entered them.
- Book, reschedule and cancel appointments within your stated hours and rules.
- Answer questions about your business from the information you have provided.
It may not
- Offer a discount, a refund, or any price you have not set.
- Guarantee an outcome or a result.
- Give medical, veterinary, legal, financial or other professional advice.
- Commit you to anything outside your configured services and hours.
When a conversation moves outside those limits — a complaint, a refund request, a health question, anything it was not told — it stops and hands the conversation to you with the full history.
Where responsibility sits
You are responsible for what the assistant says on your behalf, because it speaks only from information you supplied and within limits you configured. We are responsible for the assistant behaving as described above. If it exceeds those limits because of a fault in our software, that is ours, and you should tell us immediately. Review your assistant’s conversations — they are all in your inbox — and keep your services, prices and hours accurate, because it will quote whatever is there.
Text messaging
You are the sender of messages to your clients. You must not use Victorium Systems to send messages to anyone who has not consented, and you must not message anyone who has replied STOP.
For clients receiving messages: message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Carriers are not liable for delayed or undelivered messages.
Sending messages requires carrier registration, which takes time and is not within our control. We will not be able to send on your behalf until it completes.
Your account
Keep your login secure and tell us promptly if it is compromised. You are responsible for what your staff do with the access you grant them. Do not use Victorium Systems for anything unlawful, and do not attempt to reach another business’s data.
Payment
Subscriptions are billed monthly or annually in advance. The free trial runs 14 days and requires no card; we will not charge you without your agreement. Cancel at any time, effective at the end of the period you have paid for. We do not refund partial periods, and we will not auto-upgrade you into a higher plan without telling you first.
Your data, and leaving
Your business information and your client list are yours. We process them to provide the service and for no other purpose.
If you leave, you take your clients with you. You can export your client list and booking history at any time, including after cancelling, in a standard format. We will not withhold it, charge for it, or make it difficult.
Thirty days after you close your account we delete it. Your clients’ names, contact details, notes and appointment history, and the text of messages sent through us. Ask and we will delete it sooner.
Two things outlive that, and both protect you as much as us. We keep the record that a client agreed to be texted, and whether they later replied STOP, for five years — that is the evidence a message you sent was permitted, and it is what answers a complaint about it. And we keep opt-outs indefinitely, because the only thing worse than losing that record is texting someone who asked us not to. Neither includes what any message said.
Availability
We aim to keep the service running continuously but do not guarantee uninterrupted availability. We will give notice of planned maintenance where we reasonably can.
Liability
To the extent the law allows, our total liability in any twelve-month period is limited to the amount you paid us in that period. We are not liable for lost profits or for bookings not taken due to an outage, a carrier failure, or a third-party service being unavailable.
Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
Changes and ending the agreement
We may change these terms and will tell you before a material change takes effect. Continuing to use the service after that means you accept it. Either side may end the agreement: you by cancelling, us with reasonable notice unless you have breached these terms or are using the service unlawfully.
